Executive Power and its Limits: Are Constitutional Guardrails Working?
Stephen I. Vladeck
Professor of Law, Georgetown University
Nationally recognized expert on the federal courts; the Supreme Court; national security law; and military justice.
The first year of the second Trump administration has seen unprecedented assertions of executive power by President Trump—part of a broader pattern in which presidents of both parties have attempted to exercise ever-more unilateral authority either without statutory authorization, or even in defiance of statutory limits. This talk will walk through the original understanding of how executive power was supposed to operate (and be constrained); when and where that understanding went off the rails; the specific flashpoints we've seen over the past year; and why, without regard to partisan politics, all Americans should be invested in ensuring that the executive branch is constrained by the law.
